These Terms and Conditions ("Agreement") constitute a legally binding agreement between you ("Client") and Bates Lawn Service ("Company") regarding your use of our lawn care and landscaping services.
Service Description: Bates Lawn Service provides residential and commercial lawn care and landscaping services, including mowing, trimming, edging, fertilization, weed control, aeration, seeding, mulching, leaf removal, shrub and tree trimming, and general landscaping work. Service Estimates: All estimates are based on our assessment of your property. Final pricing may vary if actual conditions differ from our initial assessment. Service Schedule: Services will be provided according to the schedule agreed upon in your service agreement. Satisfaction Guarantee: If you are not satisfied with our services, please contact us within 48 hours of service completion, and we will address your concerns promptly. Service Warranty: Specific services may come with service-specific warranties as outlined in your service agreement.
Service Fees: You agree to pay all fees for services rendered according to the rates specified in your service agreement. Payment Methods: We accept payment via credit card, check, or electronic bank transfer. Billing Cycle: For recurring services, you will be billed according to the schedule specified in your service agreement. One-time services will be billed upon completion. Late Payments: Payments not received within 15 days of the invoice date will incur a late fee of 1.5% per month or the maximum allowed by law. Returned Payments: A $35.00 fee will be charged for any returned checks or failed electronic payments.
Service Window: We will provide services within the scheduled time window. Exact times may vary based on weather and other factors. Weather Conditions: Services may be rescheduled due to inclement weather that prevents safe or effective service delivery. Client Cancellations: You must provide at least 48 hours' notice to cancel or reschedule. Late cancellations may incur a fee equal to 50% of the service cost. Property Access: You must provide safe access to your property, including unlocking gates and restraining pets. Property Marking: You are responsible for marking sprinkler heads, septic systems, buried cables, and other hidden obstacles. We are not responsible for damage to unmarked items. Service Area Preparation: The service area must be clear of waste, toys, hoses, furniture, and other obstacles before service. Additional fees may apply if our technicians need to clear the area.
Limitation of Liability: Our liability for damages is limited to the amount paid for the specific service that caused the damage. We are not liable for indirect, incidental, special, consequential, or punitive damages. Property Damage: If damage occurs due to our negligence, we will repair or compensate at our discretion. Claims must be reported within 48 hours of service completion. Pre-existing Conditions: We are not responsible for damages resulting from pre-existing conditions, including weak fences, cracked concrete, unstable structures, or diseased plants. Acts of Nature: We are not responsible for damage caused by acts of nature, including storms, flooding, drought, extreme temperatures, or pest infestations. Indemnification: You agree to indemnify and hold harmless Bates Lawn Service from any claims or liabilities arising from your breach of this Agreement or your use of our services.
Term: This Agreement remains in effect for the duration specified in your service agreement or until terminated. Termination by Client: You may terminate recurring services with 30 days' written notice. Prepaid amounts for services not yet rendered will be refunded within 30 days. Termination by Company: We reserve the right to terminate services if you breach this Agreement, fail to pay, engage in abusive behavior, or if continuing services would present safety risks. Modifications to Terms: We reserve the right to modify these Terms at any time. Modifications are effective immediately upon posting or written notice. Continued use of our services constitutes acceptance of modified Terms.
Force Majeure: Neither party shall be liable for failures or delays resulting from events beyond their reasonable control, including natural disasters, pandemics, government restrictions, or acts of war. Governing Law: This Agreement shall be governed by the laws of the state where Bates Lawn Service is headquartered, without regard to conflict of law provisions. Dispute Resolution: Disputes shall be resolved through amicable negotiations or binding arbitration in accordance with the rules of the American Arbitration Association. Severability: If any provision is found invalid, the remaining provisions shall remain in effect, and the invalid provision shall be replaced with a valid one that reflects the original intent.
Entire Agreement: This Agreement constitutes the entire agreement between you and Bates Lawn Service and supersedes all prior agreements, whether written or oral.
